The BBC’s James Copnall says the result of the presidential poll is likely to be contested
Kenya’s Deputy Prime Minister Uhuru Kenyatta appears to have won the presidential election by the tightest of margins, provisional results indicate.
After all the votes were counted he had polled 50.03% of the vote, 4,109 votes over the threshold required for outright victory.
The official result is not expected before 11:00 on Saturday (08:00 GMT).
Rival candidate Raila Odinga is set to file a legal challenge if he loses.
One of Mr Odinga’s aides said the candidate had “no intention” of conceding defeat.
Salim Lone told the Daily Nation newspaper: “The level of the failures in the system makes it very difficult to believe it was a credible result, and if Uhuru is declared president, Raila will go to court.”
Both candidates have complained of irregularities during the course of the count, since Monday’s election.
Technical glitches
Mr Kenyatta won 6,173,433 votes out of a total of 12,338,667, well ahead of the prime minister, who polled 5,340,546 – or 43.28% of the vote.
Mr Kenyatta’s Jubilee Coalition party said it was “proud and honoured for the trust” bestowed on it, adding that it had taken a message to the people and that “we are grateful to the people of Kenya for accepting this message”.
Early on Saturday, small groups of Kenyatta supporters celebrated in Nairobi, hooting car horns and singing.
If Mr Kenyatta is confirmed by Kenya’s Independent Electoral and Boundaries Commission (IEBC), he could face difficult relations with Western countries.
He faces trial at the International Criminal Court (ICC) in The Hague in July for crimes against humanity.
He is accused of fuelling communal violence after the 2007 election that saw more than 1,000 people killed and 600,000 forced from their homes.
Mr Kenyatta’s running mate, William Ruto, also faces similar charges.
Both men deny the accusations.
The ICC has agreed to postpone Mr Ruto’s trial by a month until May after his lawyers complained of not having enough time to prepare his defence.
Countries including the US and UK have hinted that his election as president would have consequences for their relations with the Nairobi government – comments which have been dismissed in Nairobi as unwanted foreign interference in domestic matters.
Kenya’s new electronic voting system was designed to eliminate the chance of vote-rigging and with it any risk of a repeat of the post-poll violence of 2007.
But the count has been plagued with technical glitches, including a programming error that led to the number of rejected votes being multiplied by a factor of eight. By Wednesday, the electronic system was abandoned and the count restarted by hand.
According to Kenya’s election rules, the winner needs to poll more than 50% of the vote to avoid a second round run-off next month.
If the election commission confirms that Mr Kenyatta has crossed the 50% threshold by such a narrow margin, then Mr Odinga’s officials say he will challenge the outcome.
The prime minister’s Cord alliance had earlier complained that votes from 11 constituencies were missing, in effect leaving him more than 250,000 votes short.
Both men passed a second condition needed for victory – at least 25% of the vote in more than half of the 47 counties.
The Italian authorities have been accused of resorting to police state-style tactics with the introduction of a new weapon to hunt down the nation’s many tax dodgers.
The new procedure makes it possible to scrutinise any family’s spending pattern, and compare this with what it says it earns.
Tax evasion in Italy has been a chronic problem for generations.
The authorities say the equivalent of nearly 120bn euros (£100bn, $ 160bn) worth of revenue is lost every year.
And the nation’s army of tax inspectors desperately needs more firepower.
Last week, The Tonight Show aired a segment in which a couple was approached by a surprise newscast at a gas pump, which began talking to them, and got them to sing karaoke. Passed off on the show as a genuine encounter, the video went viral. Here it is, in case you haven’t seen it:

It appears that the whole thing was staged, which is apparently a surprise to some people who can’t believe that anything on the Tonight Show would actually be staged. The Smoking Gun was on the case, and reported:
Will and Monifa are both trained actors who founded a theater company in Chicago before relocating to Hollywood. Monifa, whom Chicagoist once described as a “Chicago actress of some reknown,” previously won a nationwide dramatic auditions contest by the cable network TNT.
More importantly, the “Tonight Show” never bothered to mention that Monifa appeared in a “Pumpcast News” segment broadcast more than two years ago.
In the original segment, Sims is seen at the same Burbank gas station where she was filmed singing with her husband. In fact, Monifa conversed with Stack both times while parked at pump number 16, the area used for the “Pumpcast News” bits. On both occasions, Monifa was in the same Chrysler sedan (she drove during the first taping, while her husband was at the wheel during the recent shoot). Additionally, she is seen wearing identical workout pants in each segment.
Uproxx posted the YouTube video of the original appearance, which interestingly has since been taken down by the user. Good thing The Smoking Gun still has a non-YouTube version of the video. They also point to a Facebook status update where Monifa asked her friends if they saw her on Jay Leno (in March of 2011). It looks like that might have been deleted as well.
TaeKwonDood writes with news from CERN about more results in the search for the Higgs Boson, this time from the ATLAS experiment. Researchers report peaks in the data in accordance with what they’d expect from the Higgs. The curiosity is that the peaks are a couple GeV away from each other. “The ATLAS analyses in these channels return the best fit Higgs masses that differ by more than 3 GeV: 123.5 GeV for ZZ and 126.6 GeV for gamma-gamma, which is much more than the estimated resolution of about 1 GeV. The tension between these 2 results is estimated to be 2.7sigma. Apparently, ATLAS used this last month to search for the systematic errors that might be responsible for the discrepancy but, having found nothing, they decided to go public.” Scientific American has a more layman-friendly explanation available. As this work undergoes review, physicists hope more eyes and more data will shed some light on this incongruity. Tommaso Dorigo, a particle physicist working at the CMS experiment at CERN, writes, “Another idea is that the gamma-gamma signal contains some unexpected background which somehow shifts the best-fit mass to higher values, also contributing to the anomalously high signal rate. However, this also does not hold much water — if you look at the various mass histograms produced by ATLAS (there is a bunch here) you do not see anything striking as suspicious in the background distributions. Then there is the possibility of a statistical fluctuation. I think this is the most likely explanation.” Matt Strassler provides a broader update to the work proceeding on nailing down the Higgs boson. SOLDIERS from 1 Scots packed up and left after completing their last ever tour of Afghanistan today.
In a ceremony on Camp Tombstone, a base alongside Camp Bastion which is shared with the Afghan National Army (ANA), the regiment handed over their duties to 4 Rifles.
They are responsible for running the Brigade Advisory Group, preparing the ANA to go it alone in Helmand province once coalition combat operations come to an end next year.
Immediately after their flag was lowered, the 1 Scots insignia was removed from the parade ground as they loaded their bags on to a waiting truck. They will fly back to the UK tomorrow.
Commanding officer, Lt Col Ben Wrench, said: “We are very pleased to be returning home after what has been a rewarding tour.
“The ANA has made huge progress since we were last here in 2010 and this is allowing us to leave Afghanistan in an orderly manner.
“Our mentoring is becoming less and less hands on as they take the lead in planning and executing their own operations.
“What we are working on now is creating a professional army which can sustain itself.
“This means focusing on areas such as artillery, mortar and how to plan their own logistics.”
He added that he believed it was possible for the ANA to significantly disrupt the activities of the insurgency.
“I think we flatter the insurgency by describing them as an insurgency,” he said.
“They are no longer the organised and committed force they once were.
“For many it has just become a way of life – they are motivated by income rather than ideology.”
Lt Col Tom Bewick, commanding officer of the incoming 4 Rifles, is on his third tour of Afghanistan.
He said the approaching fighting season, in which the ANA will take on sole responsibility for offensive operations, could see the Afghans prove they are ready to take responsibility for security in Helmand.
“My first two tours of Afghanistan, in 2009 and 2010, involved full on fighting,” he said.
“This tour will be an opportunity to reflect on how far we have come.
“There is still work to do in professionalising the command structures of the ANA, but we shouldn’t be cynical about their ability.
“There is a lot of focus on this being the first fighting season on their own, but they have been taking on a growing role for six years.
“They are more than up to the job at this important time.”

Fallacious and vicious neocon war rhetoric has claimed its latest victim – an Indian man in New York who was pushed into the path of an on-coming train and crushed to death.
“In a hate crime against Hindus and Muslims, a New York City woman pushed an Indian man in front of an oncoming subway train, causing him to be crushed to death in the second such murder to occur this month,” reports RT.
“I pushed a Muslim off the train tracks because I hate Hindus and Muslims ever since 2001 when they put down the twin towers. I’ve been beating them up,” Richard A. Brown, the Queens district attorney, quoted the woman as saying.
In other words, the myth that Muslim cave dwellers half way around the world brought down three skyscrapers convinced a deluded woman that she had to kill an Indian man.
Hindus were not implicated in the terrorist attack. Hundreds of innocent Muslims, however, were rounded up like criminals or Japanese citizens during the Second World War. Anti-Muslim propaganda spun off crackpot neocon theories cooked up in the Pentagon and so-called think tanks managed to brainwash millions of Americans into believing they hated us for our freedom.
Incidentally, we are not calling for the First Amendment to be outlawed. We are simply using this unfortunate incident as an example.
Liberals, Democrats and other gun-grabbers accuse inanimate objects of killing school children, a proposition that is about as absurd as stating that a man hooked up to a kidney dialysis machine living in a remote cave in Afghanistan was responsible for hijacking planes and plowing them into the WTC and suspending the laws of physics in the process.

Dorothy Thornhill is the political leader of Watford Borough Council and the borough’s first Directly Elected Mayor.
The mayor of Watford, Dorothy Thornhill, told the local newspaper today she fears violent protests at the upcoming Bilderberg conference. The mayor would be wise to consider signing up for a crash-course on how not to escalate an event before it even takes place.
“I have my concerns about it because it does attract people who can and do cause violence and disturbance.”, Thornhill told the Watford Observer. Although she added she is “confident the police will be able to minimise that”, she appears to suck up to the global elite by stating “it is very good the Grove has been deemed a prestigious enough venue.”
The Watford observer ran another article today, noting that close to a thousand protesters may be present around the cordoned-off area of the Grove Hotel and its immediate surroundings.
“Most of The Grove’s grounds will be closed to the public while the conference takes place and Hertfordshire Constabulary will be given the job of keeping the crowds out.”, the report reads.
The local newspaper insists on describing the expected demonstrators as “crowds” of conspiracy theorists, ready to run over the gates and storm the Grove Hotel. It doesn’t mention that the annual confab usually attracts peaceful but critical protesters. Talking about last year’s conference in the US, the reporter for the Watford observer implicitly expresses doubt that the protesters will abide by the law:
“In the main the crowds (at Bilderberg 2012) were kept confined to the lawns outside the hotel, and although the barriers were strictly enforced, there were no reported arrests. Whether Watford can expect the same crowds is yet to be seen.”
These passive-aggressive words by an uninformed local reporter, and the foolish statements made by mayor Thornhill, seem to echo some feeling of discomfort on the part of the local establishment at the prospect of their area filling up with critical people trying to make sure the media blackout on Bilderberg does not endure. This feeling of discomfort is understandable. But, like any vague disturbance of the mind, it would be wise for them to reach for the roots of their discomfort. It is not the protesters that should be their main concern. It is the fact that the world’s political, financial and military elite meet in absolute secrecy, including their own elected officials.
Five weeks after ExxonMobil’s Pegasus pipeline ruptured and spewed thousands of barrels of tar sands oil in Mayflower, Arkansas, residents are stuck “on their own” as they suffer from health problems following noxious black cloak that enveloped their neighborhood.
“Both the subdivision and the cove look more like construction sites than neighborhoods,” Arkansas Attorney General Dustin McDaniel said at a press conference on Tuesday of the cove area of Lake Conway. “There’s heavy equipment everywhere, much of it contaminated with oil as it goes down roads and through people’s yards.”
And in contrast to claims from the government and ExxonMobil that the air is safe to breathe, McDaniel said, “Many continue to suffer from headaches and nausea and air sampling continues to show the carcinogen benzene remains in the air.”
As InsideClimate News reported Wednesday, Arkansas Department of Health residents who’ve been experiencing symptoms like nausea, vomiting and dizziness are “on their own.” Dr. William Mason, chief of emergency response at the Arkansas Department of Health, said that if people in the area of the tar sands spill were feeling adverse health effects, “the option for them to leave is their personal choice.”
Georgia Senator Saxby Chambliss (R) will not seek another term. Instead of running again in 2014 Chambliss has decided to retire according to the Atlanta Journal-Constitution.
U.S. Sen. Saxby Chambliss will announce this morning that he’s dropping plans to run for a third term in 2014, a decision certain to set off an avalanche of Republican candidates who will seek to replace him.
Word out of Washington is that Chambliss broke the news to his senior staff this morning.
Chambliss was potentially going to a face a primary challenge because he is seen as compromising too much with Senate Democrats. Polling by PPP found that Chambliss may have been vulnerable to a conservative opponent running to his right.
Chambliss had a decent job approval rating and PPP found he would have been a strong general election candidate if he survived a primary. Without him in the race Democrats chances of picking up the seat would have likely improved some but it is still going to be a tough contest for Democrats to win. Mitt Romney did won 53 percent of the vote in Georgia last year.
